Neurosurgeon an apparent victim in medical malpractice matter

Even doctors can be victims of medical malpractice.  One neurosurgeon was struck in the eye while performing a procedure.  He in turn then underwent a surgical procedure intended to repair the damage to the eye on Jan. 14, 2011.  Instead, a hole was apparently torn into the doctor's iris during the procedure and this resulted in the left pupil being destroyed.  This has prevented this doctor from working since that time.

A medical malpractice case has since then ensued.  The jury awarded the doctor $7.7 million for the purported surgical error.  A portion of this verdict amount concerned compensation for past and future lost wages.

It must be remembered that jury verdicts are not always the end of the story when it comes to medical malpractice lawsuits. In the above matter, for example, the attorney representing the facility that performed this surgery reported that the clinic was considering appealing the verdict. This attorney pointed out that the verdict was not unanimous. He further stated that such a verdict did not appear to be "consistent with the evidence presented."

According to the attorney for the injured doctor, the evidence presented in this matter was overwhelmingly in favor of his client. While the verdict was not unanimous, six of eight jurors did support the ruling.

Though the above matter did not take place in New York, we do see surgical error cases pop-up in our state as well. Extensive investigation and research is required whenever an attorney decides to represent an injured victim in a medical malpractice claim. Severe damage can be inflicted as the result of medical malpractice. Even seemingly routine procedures can result in injury from a surgical error that may prevent an individual from working in their chosen field.
