What are my options if a car accident is my fault?

Perhaps you were texting while you were driving. Perhaps you were drowsy, intoxicated or emotionally agitated. Or perhaps you were simply driving in rough conditions. Whatever state you were in when you unintentionally caused a motor vehicle accident, it is important for you to understand that you likely still have legal options available to you.

Some accidents do occur due to the negligence or recklessness of one individual. However, many accidents occur due to a host of factors. The law tends to take notice of this fact. Depending on the laws of your state and the particular circumstances surrounding your accident, you may be able to avoid having to take total responsibility for your accident. You may even be able to receive compensation if the accident was not solely your fault.

It is for these reasons that it may benefit you to speak with an attorney about your legal options. Very few states still observe the theory of contributory negligence, in which a driver cannot receive any damages if an accident was in any way his or her fault. Instead, most states observe the theory of contributory negligence in which drivers may potentially receive compensation provided that they are less than 50 percent to blame for the harm caused by an accident.

Some states even observe no fault approaches to accidents in which insurance payments and damages for injuries may be received even if a driver is at fault for an accident.
