Construction Accidents invoke Workers Comp & Personal Injury Laws

Personal injury and workers compensation are two different areas of the law, both of which may afford an injured employee recourse if hurt in a Construction Accident.

For example, a construction worker who falls off of a scaffold at a job site and breaks his arm may seek workmans compensation through his employer.  In addition to seeking workers comp, the injured party may have a viable personal injury lawsuit if the general contractor or the owner of the building failed to provide the worker with the proper construction safety equipment.  

Beware, if the company you work for is the same entity that owns the premises or building where you got hurt, you may be barred by workers compensation from suing your employer in a personal injury action.

New York's labor law is extensive.  It is important you consult an attorney.
