Many instances of truck drivers' texting while driving reported

A New York couple was killed approximately one-year ago when a tractor-trailer rear-ended their vehicle. The trucker was said to have been texting at the time the accident occurred.

The husband who was driving the car was coming to a stop when the trucker negligently rear-ended and pushed their vehicle into another truck.

This is not the only incident of this kind. One other truck driver killed a police officer after crashing into a variety of emergency vehicles. The truck driver was reportedly looking at pictures on his phone at the time of that accident.

A television investigation in New York City resulted in camera footage showing truck drivers engaged in dialing and texting on their cellphones. One truck driver was observed carrying on conversations on two separate phones apparently at the same time.

Truck drivers in New York could receive a $150 fine for talking on the cellphone while operating their trucks. They also accumulate points for each arrest, and enough points in an 18-month period could result in a license suspension. However, since the behavior of texting and driving among truck drivers appears to have continued, one member of the National Transportation Safety Board has suggested that enforcement does not appear to be strong.

It is bad enough when anyone texts and drives. To see this behavior among truck drivers, however, is even more disturbing. While personal injury attorneys cannot enforce the law, we can represent clients when accidents do occur and a truck driver happens to be negligent. In those circumstances, rather than hit them with a $150 fine the truck driver or his employer may ultimately be responsible for reimbursing injured parties for medical expenses, wage losses and for pain and suffering.
