Does Joan Rivers' death warrant medical malpractice suit?

The entertainment world is still reflecting on the recent death of comedian Joan Rivers. But the passing of the entertainer is probably being felt more in New York than anywhere else. After all, Rivers hailed from Brooklyn and grew up in Larchmont.

One of the big questions whirling around in media circles is whether her death could prompt her surviving family to pursue a wrongful death lawsuit based on a claim of medical malpractice. This is a question that would seem to stem logically from the fact that mystery shrouds exactly how she came to die. 

Rivers was 81, reportedly in good health, and still booking appearances, when she went into a Manhattan outpatient clinic at the end of last month. While in the facility, she reportedly stopped breathing and suffered a heart attack. She was taken to Mount Sinai hospital as a result, where she died a week later.

Some news reports indicated that Rivers went into the clinic for an elective procedure because of vocal cord issues. But exactly what actually took place remains unclear. The clinic has denied reports that Rivers was under general anesthetic and underwent an unplanned vocal cord biopsy. But it hasn't said what did happen, citing the seal required by privacy laws.

Meanwhile, state and city officials have confirmed that they are investigating the clinic and the medical examiner's office says a final determination of what caused her death is pending results of further studies.

From an emotional standpoint, it is understandable that those feeling the effects of this unexplained death would want justice. But pursuit of a medical malpractice claim of wrongful death can be difficult unless negligence can be proven. If a claim for compensation is sought, it will require an attorney's astute examination of medical records and a determination that there is evidence to support an allegation that there was a failure to deliver an appropriate standard of care.
