Truck driver in accident that killed James McNair indicted on criminal charges

In June of 2014, a limousine van carrying several well-known comedians was traveling along the New Jersey Turnpike when traffic slowed up ahead. As the driver of the van adjusted his speed accordingly, from behind, a huge tractor trailer truck came barreling down the highway.

The driver of that truck had been awake for more than 24 hours and working for 13 when he failed to notice the slowed traffic and crashed into the back of the limousine. Comedian James McNair was killed in the horrific crash and four others were seriously injured including former Saturday Night Live cast member Tracy Morgan.

Since the crash, McNair's family and friends have been cast into the spotlight as they grieved their loved one's death. The truck that was involved in the fatal crash was owned and operated by Walmart which subsequently agreed to settle a civil lawsuit "paying an undisclosed sum to the victims and their families." A grand jury recently indicted the driver of the truck on criminal charges including manslaughter, aggravated assault and vehicular homicide.

In the 18 months since the crash, Tracy Morgan has struggled to recover from and cope with the devastating and debilitating injuries he suffered which included a traumatic brain injury, broken leg and broken ribs.

The emotional, physical and financial costs associated with serious and fatal motor vehicle accidents are often difficult to quantify. While nothing can change what happened or bring a loved one back, taking legal action can help crash survivors deal with the financial burdens associated with an accident and also potentially bring about other important changes. In this case, since the crash, Walmart instituted a new policy to help ensure that truck drivers are sufficiently rested before beginning their shifts.
