Discussing some oddities in premises liability law

Premises liability is a constant in the world of law. Any building can be the site of a premises liability incident if there are dangerous conditions present. Employees and building managers could be at fault too for not putting up warning signs or addressing clear dangers to patrons.

But there are some buildings that have unique traits to them when it comes to premises liability law. Let's take a look at a few of them:

  • Hotels. If you slip and fall in a hotel due to a dangerous condition, then the hotel can be held liable, depending on the circumstances. What a hotel can't be held liable for is a crime that occurs on or near the property if they took steps to address or prevent the crime.
  • Banks. Withdrawing money at an ATM can lead to people being attacked, and in lawsuits against banks for failing to protect people at ATMs, this argument has been held up. It is by no means a guarantee, but there are examples of lawsuits against banks succeeding because the bank failed to protect their clients.
  • Sidewalks. This is a tricky one, because many cities or municipalities have immunity to liability if someone slips and falls on a sidewalk. But there are places that allow such lawsuits to go forward. If you slip and fall on a busted sidewalk, research your local statutes to see if liability can be applied.

In any of these cases, of course, you should have an attorney by your side.
