Plumber wins appeal of slip and fall lawsuit, case will proceed

Today we have yet another example of an individual that became a victim after the premises he was working on lacked the necessary safety to allow him to do his job -- and as a result, he suffered injuries.

The incident was in 2011, when a plumber was working at a school for a renovation project. His tools were downstairs, and as he went down to get them, he slipped and fell in the staircase. He broke his leg and the injury required surgery. The plumber claimed that the staircase wasn't properly lit, and as a result he couldn't really see where he was going -- leading to the slip and fall.


When the plumber sued, a lower court dismissed the plumber's claim. But he appealed the decision, and the appellate court determined that the man's case should proceed -- thus overturning the lower court's decision.

There are a couple of things to learn from this story. The first is that the legal processes behind a slip-and-fall can create quite a long road for the plaintiff. There may be numerous appeals and legal hurdles that need to be cleared, and as such, it is important for the plaintiff to have experienced legal representation throughout the process.

The second thing to note from this story is that slip and fall cases can come in all shapes and sizes. Premises liability can occur because of spilled liquids, poor lighting, dilapidated structures, improper responses to dangerous conditions and a bevy of other potential factors.
