A closer look at premises liability

One of the areas of premises liability that we extensively discuss on this blog is slip and falls. These are terrible incidents and the victims of the falls often suffer brutal injuries. But this isn't the only legal concern that can crop up in relation to premises liability.

Another common cause of a premises liability lawsuit is a building that wasn't secured properly. This could happen because the building had no security at all, or because it should have had security in light of recent events (thefts or attacks on the property). Additionally, locks on or in a building could be broken or shoddy, and a landlord or building manager is supposed to tend to these issues promptly.

An insidious form of premises liability is when a structure is infested with mold, mildew other some other biological agent that causes the tenants or visitors to suffer horrible medical complications. Respiratory issues can arise as a result of these unacceptable building conditions, in addition to headaches and other debilitating ailments. As with the security concerns, these "sick buildings" can, and should, bring about a premises liability lawsuit by afflicted tenants or guests.

And then there can be structural collapses or problems. What if a staircase collapses? Or a shelving unit that was installed by the property manager fell off the wall due to inadequate work by that building manager? These are just a couple of examples of structural issues that can leave a property manager or landlord liable for any resulting injuries.
