Woman sues hospital after standing water causes her fall

While the following story didn't occur here in New York, it has all the hallmarks of a traditional and all-too-common slip and fall accident. It also highlights the most infuriating trend in the world of slip and falls.

A woman has sued University Healthcare Systems (which is doing business as Tulane University Hospital and Clinic) for an incident that occurred last summer. The woman says as she was walking on the plaintiff's property, she slipped in some standing water. The defendant did not do anything to warn the injured plaintiff of the standing water. Few other details have been provided in the source article, but there is enough here to understand what happened here.

It is astonishing to see just how many slip and fall accidents occur because a business, company, restaurant or other establish either failed to see a spill on the ground or didn't take the necessary steps to clean the spill and alert patrons of the danger (or all of the above). Addressing standing water or slippery conditions should be a high priority for all companies and businesses. And if they can't clean it up right away, then their priority should be to get a warning cone or sign out to alert patrons to the danger.

Instead, many companies just procrastinate and don't address the issue that is sitting there on their floor. Such negligence in the eyes of premises liability law can lead to a business or property manager being held liable for any slip and fall.
