Fall in shower at hotel leads to lawsuit

A man who stayed at a Hampton Inn in 2016 slipped and fell in the shower. He has since filed a lawsuit against Winchester Hospitality, which was doing business as Hampton Inns, for what he says is their negligence.

Now, if we left the story at just that, you would probably think the plaintiff is filing excessive litigation here that doesn't reflect the circumstances. You may assume that this person just slipped in the shower, composing a true accident as opposed to a negligent incident perpetrated by the manager of the premises.

But there is a crucial additional detail to this story: Winchester Hospitality removed the safety stripping in the shower without warning the guest or notifying him in any way -- may that be with a cautionary cone or some signage that explained the situation. Instead, the stripping was simply removed without any acknowledgment, and the plaintiff says this constitutes a known dangerous condition that the defendant willingly caused.

The plaintiff alleges that Winchester Hospitality has a duty to keep their guests safe and that they were negligent in their care for their premises. He is requesting compensatory and punitive damages for the slip and fall.

If we've said it once, we've said it a thousands times: businesses have a duty to protect their patrons and guests. Warnings and appropriate signage is a simple, effective means of alerting people to potential dangers on their premises. When they fail in this regard, they should be held accountable.
